Part A - Private animal owners

A1. Scope, precedence and conflicting terms

A1.1 These Terms govern all dietary-advice services I provide to private animal owners online (video call, email, telephone): Quick Info, Diet Check, Diet Optimisation and Follow-up (each a "Service"). "Quick Info" is a short orientation call without a written calculation.

A1.2 Urgent Advice is available to veterinarians only and is governed by Part B and the separate Partnership Agreement, not by Part A.

A1.3 Where an individual agreement and these Terms conflict, the individual agreement prevails. The application of any general terms of the Client is excluded, even if I do not expressly object.

A2. Nature of the Service: mandate, not a guaranteed result

A2.1 Each Service is a mandate (Auftrag) under Art. 394 ff. of the Swiss Code of Obligations (OR). I owe diligent performance using current scientific knowledge, not a specific result. The relationship is a mandate, not a work contract (Werkvertrag); any written plan is a recommendation, not a warranted work product.

A3. Limits of the Service

A3.1 I am a licensed veterinarian. My Services are veterinary nutritional advice, education and dietary support based on the information provided. Nutritional management may itself constitute treatment and, more often, supports the treatment plan of the treating veterinarian. I do not make definitive diagnoses remotely, do not prescribe veterinary medicines remotely, and my Services do not replace a physical examination.

A3.2 For an animal under veterinary care, my advice provides nutritional support within, and based on, the treating veterinarian’s diagnosis and treatment plan; that veterinarian remains responsible for the diagnosis and overall treatment.

A3.3 I may decline or pause a Service and refer you to an in-person veterinarian whenever I consider physical examination or urgent care clinically indicated. My Services are not an emergency service. In an emergency, or if your animal is unwell, contact a veterinarian in person immediately. do not wait for or rely on my advice.

A3.4 Booking prerequisites. Before a Service is booked you must submit the animal’s relevant history and the name and contact details of your treating veterinary practice (if any). Where no clinical history is submitted, the attestation in A3.5 applies.

A3.5 Health and accuracy attestation. By booking you confirm that, to the best of your knowledge, all information you submit is correct and complete. Where you do not submit a clinical history, you attest that your animal is not currently undergoing veterinary treatment and that you have no reason to believe it currently requires veterinary attention. If this changes, you will tell me before I provide advice.

A3.6 Sharing advice with your veterinarian. I recommend that, for any animal presented as healthy, you provide a copy of the advice to your treating veterinarian for the clinical records, and that you consult your veterinarian before significant dietary changes for an animal with any health concern. I may also include this recommendation in the report.

A3.7 Availability by residence. Direct booking and self-submission by an owner are available to owners resident in Switzerland. An owner resident abroad may self-submit only where their veterinarian (or a qualifying pet professional) is a Partner holding a referral code; in that case, billing and the provision of the report are routed through that professional. Where the professional is not a Partner, an owner resident abroad cannot self-submit. This keeps any cross-border engagement on a business-to-business basis.

A4. Cooperation and accuracy

A4.1 You will provide all support, documents and materials reasonably required (current feeding, products, history, lab results). Inaccurate or incomplete information may impair the advice; I accept no liability for consequences of inaccurate or incomplete information you provide.

A5. Cooperation and accuracy

A5.1 For online Services you need suitable equipment and a stable internet connection (including for video calls); you are responsible for these. I am not liable for interruptions caused by your equipment or connection.

A6.1 Listed prices are minimum prices. Hourly Services are billed per commenced [quarter-hour]. Where a cap applies, you are not charged above it. The price and any upgrade conditions are shown with each Service on the website, and I confirm with you before exceeding a price level (e.g. Diet Check to Optimisation).

A6.2 Follow-up requests. A follow-up on a completed case is requested via the website follow-up form; simple updates you share are not charged, further questions or plan changes are chargeable, and a follow-up involving a new diagnosis or recipe is priced as a Diet Optimisation. You acknowledge this when submitting a follow-up request.

A6.3 Prices are not subject to Swiss VAT (MWST), as I am not currently VAT-registered. Should I become VAT-registered, VAT will be added where applicable.

A7. Payment and default

A7.1 My fee is due within 15 days of invoice. On default you owe default interest of 5% p.a. (Art. 104 OR) and a reminder fee of CHF 15 per reminder. If you are concerned you may not be able to pay on time, contact me before the due date to arrange instalment payments. If I have doubts about timely payment, I may require advance payment or security.

A8. Cancellation, rescheduling and no-show

A8.1 An appointment can be cancelled or rescheduled up to 24 hours in advance; within 24 hours, contact me by email. If you do not attend and have not notified me in advance by email, the appointment is charged at the Quick Info price (for a Quick Info) or the Diet Check price (for a Diet Check or Diet Optimisation). With advance email notice the appointment can be rescheduled without charge. A genuine impediment beyond your control (e.g. family illness) may be considered under A10.

A9. Liability

A9.1 I am liable for damage caused by unlawful intent or gross negligence. To the extent permitted by law, liability for slight negligence is excluded, as is liability for auxiliary persons (Art. 101 OR). I am not liable for outcomes affected by inaccurate information, your failure to follow advice or to seek in-person care, or decisions by you or third parties. Mandatory liability (e.g. personal injury) is unaffected.

A10. Force majeure

A10.1 Neither party is liable for delay or non-performance caused by events beyond its reasonable control (outages, platform failures, illness, official measures). Affected obligations are suspended; either party may withdraw from the affected Service if the impediment persists beyond [30] days.

A11. Confidentiality and data protection

A11.1 I treat information obtained in the engagement as confidential, including after it ends.

A11.2 I process your and your animal’s data to provide the Services in accordance with the revDSG (and the GDPR where applicable) and my Privacy Policy at [link], which forms part of these Terms. Services are delivered via video calls in my practice-management platform (Odoo Discuss), by telephone and by email. I do not record consultations without your prior consent. Email is not encrypted; avoid sending especially sensitive data by email.

A11.3 I keep a clinical record for every client and animal. I do not disclose your identifiable data to any third party except: processors acting for me under confidentiality; where legally required; and — where your case reached me through a referring professional — that referring professional, who retains access to the case they referred (including via my client portal) to co-manage the animal. Any data used for analytics, research, education or anonymised case studies, or otherwise shared more widely, is anonymised or aggregated so that no individual can be identified (see the Privacy Policy).

A11.4 Client portal and follower rights. Once a consultation has been provided, you and, where applicable, your referring professional receive access to the case in the client portal; access is bound to the email address you provided. The default follower configuration is applied automatically when the case is finalised and reflects the recipient option chosen at booking (owner / veterinarian / pet professional or a combination) and the owner's country of residence (Switzerland or abroad). A referring practice is treated as a single access point: any veterinarian working at that practice can view the cases referred by the practice. Changes to the access rights, for example if you change your treating veterinary practice, or if you wish to grant access to a practice retroactively, can be requested informally by email at any time; I will adjust the followers accordingly.

A12. Intellectual property

A12.1 Plans and materials I produce are for your own private use for the relevant animal; they are case-specific and not usable by third parties. I retain all rights; no publication, resale or commercial use without my written consent.

A13. Amendments and final provisions

A13.1 I may adjust my Services, prices and these Terms at any time and will inform you of changes in advance; the version accepted at booking governs that booking.

A13.2 Swiss law applies (excluding conflict-of-law rules and the CISG). Place of jurisdiction: Zurich, Switzerland, subject to mandatory consumer fora (a consumer may also sue/be sued at their Swiss domicile). If any provision is invalid, the remainder stays in force, replaced by the closest valid provision.

Acceptance (owners, before payment). To book you tick each box separately; booking cannot complete until all required boxes are ticked:

  • ☐ I have read and accept the Terms & Conditions and the Privacy Policy.
  • ☐ I understand this is nutritional advice and education, not a diagnosis, treatment, prescription or emergency service, and that it does not replace an in-person veterinary examination. In an emergency I will contact a vet in person.
  • ☐ I confirm the health and accuracy attestation in A3.5.

Part B - Professional referrals (veterinarians and pet professionals)

B1. Acceptance and authority

B1.1 By submitting a case, a veterinarian, practice or pet professional (the "Referrer") accepts Part B and confirms it is authorised to act for the practice/business named, and that the Referrer’s own general terms are excluded.

B1.2 Referral itself needs no contract. Without a signed Partnership Agreement, standard list prices apply and no referral code or discount is available.

B2. Nature and limits

B2.1 Services referable by professionals are Diet Check, Diet Optimisation and Quick Info; Urgent Advice can be requested by veterinarians only. All are mandates; diligent performance is owed, not a result. I do not diagnose or prescribe remotely; Services do not replace a physical examination. Where clinically indicated, I recommend in-person examination.

B3. Veterinarian referrals

B3.1 By submitting a case, a veterinarian/practice confirms, per case, that it has obtained the owner’s consent to submit the case and data to me, and that the owner was informed that anonymised/aggregated data may be used for research, education and anonymised case studies.

B3.2 For any animal that is not healthy, the veterinarian provides the diagnosis and workup, so that my nutritional support rests on the veterinarian’s clinical assessment.

B3.3 Urgent Advice is available to veterinarians on a best-efforts basis (response targeted within 24 hours). It is not for acute emergencies, which require in-person care. The standard rate is CHF 250/hour (reduced partner rate under the Partnership Agreement).

B4. Pet professional referrals (e.g. pet shop, groomer, trainer)

B4.1 Pet professionals may submit a Diet Check, Diet Optimisation or Quick Info (not Urgent Advice).

B4.2 A pet professional should normally refer healthy animals. Where the animal is not healthy, the case is handled only as a veterinary referral: I require the treating veterinarian’s diagnosis and clinical records before giving any advice, and will request them if not provided. By submitting, the pet professional confirms it has obtained the owner’s consent to submit the owner’s and animal’s data (incl. anonymised research/education/case-study use).

B5. Accuracy, data protection, fees

B5.1 The Referrer confirms the submitted information is, to its knowledge, correct and complete, including the animal’s history and the treating practice’s details. I am not liable for consequences of inaccurate or incomplete information.

B5.2 For a referral I become the controller of the resulting client/animal data, keep a confidential clinical record, and do not disclose identifiable data to third parties except to the Referrer that submitted the case — who, having obtained the owner’s consent, retains access to the case it referred (including via my client portal) to co-manage the animal. Wider use is anonymised/aggregated. The Referrer is responsible for having informed the owner and obtained these consents.

B5.3 Fees: standard list prices (no discount unless a Partnership Agreement applies); payment within 15 days; on default 5% p.a. interest (Art. 104 OR) and a reminder fee of CHF 15 per reminder.

B5.4 IP and liability: plans and materials remain mine; the Referrer/owner receives a non-exclusive, non-transferable licence for the relevant animal. Liability for slight negligence and for auxiliary persons (Art. 101 OR) is excluded so far as permitted; I am not liable for the Referrer’s clinical decisions. Confidentiality applies both ways. Swiss law; jurisdiction Zurich, Switzerland.

Acceptance (professionals, at submission). Shown above the submit button, per case: "By submitting this case I confirm that I am authorised to act for [practice/business]; I accept Part B (Professional referrals); the information is accurate and, for any animal that is not healthy, I have provided (or will provide) the diagnosis and workup; and I have obtained the owner’s consent to submit this case and data, including anonymised research, education and case-study use."
